www.sendstuffnow.com, store.smithmicro.com, motionartist.tv,
(collectively, the "Sites"). In addition, there may be supplements
to this Policy for particular Smith Micro solutions as made available in such
Sites. This Policy does not address our practices regarding information that we
collect through any website, or by any other means, other than through the
Sites; nor does this Policy govern the collection, use or disclosure of
information by any of our affiliates (collectively, "Affiliated Entities") or by
third parties. This Policy does not
apply to those sites that do not display or link to this Policy or that have
their own privacy statements. Please

The Site is made available by Smith Micro subject

1. What Types of Information Does Smith Micro Collect From Me?
Smith Micro gathers two basic types of information
through the Site: "Personally Identifiable Information" (or "PII")
and "Non-Personally Identifiable Information" (or "Non-PII").
Personally Identifiable Information is information that identifies a person as
an individual, including without limitation, name, email address, postal or
other physical address, telephone number, credit or debit card number (or other
payment account number), title, occupation, and other information.
Non-Personally Identifiable Information is aggregated information, demographic
information and any other information that does not reveal a person's specific
identity. An IP Address is the Internet Protocol address of the computer that
you are using.
a. Personally Identifiable Information.
You do not have to provide PII to use the Site. However, in order for you to take advantage
of particular opportunities provided through the Site (for example, to sign up for a newsletter
or order products from the Site), we may require that you furnish PII. We collect PII from you
through the Site only when you voluntarily provide it to us. Smith Micro is committed to protecting
the Personal Information you share with us. When we transfer sensitive personal data (for example,
credit card information) over the Internet, Smith Micro protects it using Secure Sockets Layer (SSL)
encryption technology. Smith Micro utilizes a combination of industry-standard security technologies,
procedures, and organizational measures to help protect your PII from unauthorized access, use or disclosure.
However, no method of transmission over the Internet, or method of electronic storage is 100% secure.
Therefore, while we strive to use commercially acceptable means to protect your PII, Smith Micro cannot
guarantee its security. Smith Micro recommends you to take every precaution in protecting your PII when
you are on the Internet. For example, change your passwords often, use a combination of letters and numbers
when creating passwords, and make sure you use a secure browser. We also may use third-party payment services
(each, a "Payment Service") to collect payments made through the Site. When we use a Payment Service, you will be directed to a webpage that is hosted by the Payment Service (or the Payment Service's service
providers) and not by Smith Micro (such page, the "Payment Service Page"). In addition, any PII that you provide
through the Payment Service Page may be collected by Payment Service(s) and not by Smith Micro, and will be subject
responsible for, Payment Service's use of information collected through the Payment Service Page. PLEASE NOTE
THAT THIS POLICY DOES NOT ADDRESS THE COLLECTION AND USE OF INFORMATION THROUGH THE PAYMENT SERVICE PAGE OR THE
PRIVACY OR INFORMATION PRACTICES OF ANY PAYMENT SERVICE.
b. Non-Personally Identifiable Information.
When you visit and interact with the Site, Smith Micro and third parties
with whom Smith Micro has contracted to provide services to Smith Micro may
collect Non-PII (for example, a catalog of the Site pages you visit). Non-PII is
generally collected through the Site from four different sources: (i)
environmental variables, (ii) cookies, (iii) pixel tags and other similar
technologies, and (iv) information that you voluntarily provide to us.
i. Environmental Variables.
We and our service providers may also collect certain environmental variables,
such as your MAC address, computer type (Windows or Macintosh), screen
resolution, OS version, Internet browser, and Internet browser version. These
environmental variables are collected by most websites, and can be used to
optimize your experience on the Site.
We and our service providers may use "cookies" on the Site. Cookies are data
that a web server transfers to an individual's computer for recordkeeping and
ongoing access to and use of our Site. If you do not want information collected
allows you to automatically decline cookies, or to be given the choice of
declining or accepting the transfer of a particular cookie, or cookies from a
particular website, to your computer.
iii. Pixel Tags.
We and our service providers may also use so-called
"pixel tags," "web beacons,"
"clear GIFs," or similar means (collectively, "Pixel Tags") in connection with
Site pages and HTML-formatted email messages to, among other things, track the
actions of Site users and email recipients, to determine the success of
marketing campaigns and to compile aggregate statistics about Site usage and
response rates. A Pixel Tag is an electronic image, often a single pixel (1x1),
that is ordinarily not visible to Site visitors and may be associated with
Cookies on the visitors' hard drives. Pixel Tags allow us to count users who
have visited certain pages of the Sites, to deliver branded services, and to
help determine the effectiveness of promotional or advertising campaigns. When
used in HTML-formatted email messages, Pixel Tags can tell the sender whether
and when the email has been opened.
iv. Information That You Voluntarily Provide.
Smith Micro also collects Non-PII (e.g., your interests, your geographic
location, etc.) when you voluntarily provide such information to us. Such
information constitutes Non-PII because, unless combined with PII, it does not
personally identify you or any other user. Additionally, we may aggregate PII in
a manner such that the end-product does not personally identify you or any other
user of the Site, for example, by using PII to calculate the percentage of our
users who have a particular telephone area code. Such aggregate information is
considered Non-PII for purposes of this Policy.
c. IP Addresses.
When you visit and interact with the Sites, Smith Micro and third parties with
whom Smith Micro has contracted to provide services to Smith Micro may collect
IP Addresses. Your Internet Protocol (IP) address is a number that is
automatically assigned to the computer that you are using by your Internet
Service Provider (ISP). This number is identified and logged automatically in
our server log files whenever you visit the Sites, along with the time(s) of
your visit(s) and the page(s) that you visited.

information for any purpose. In addition, we reserve the right to share such Non

third parties, for any purpose.
In some instances, we may combine Non-PII with PII (such as combining your name

services (for example, if you choose to make a purchase through the Site, we may
share your Payment Information or other PII with our third party service
providers to fulfill your purchase, including, without limitation, to process
your credit card or payment account number or to ship products to you). For avoidance of doubt, if you are making a purchase through the Site, we or our Payment Services may disclose your Payment Information to banks, processors, card associations, and other financial institutions that are involved in the course of processing or screening the transaction applicable to the Payment Information. At this time, we currently use the following two Payment Services: Paypal and Authorize.net.

We reserve the right to share the PII you provide in connection with Promotions
with third parties sponsors of such Promotions (irrespective of whether such
Promotions are hosted by us), or otherwise in accordance with the rules
applicable to such Promotion. You should carefully review the rules, if any, of
each Promotion in which you participate through the Site, as they may contain
additional important information about a sponsor's or other third parties' use
of PII about you. To the extent that the terms and conditions of such rules
concerning the treatment of PII about you conflict with this Policy, the terms
and conditions of such rules shall control.
